His main opponent in the race was a senator from the opposition APC, Smart Adeyemi. The tribunal removed him from office on August 23, 2019, and a new election was mandated. On October 11, 2019, he finally lost his appeal to keep his senate seat after a series of clashes with the Nigerian government and Kofi state government. He promptly ordered a redo of the INEC election. INEC postponed the election from the Senate governorship election scheduled for November 16, 2019; nonetheless, he sorted and petitioned INEC to have his rerun election take place on the same day as the state governorship election.

Dino Melaye was defeated by Smart Adeyemi by a margin of over 20,000 votes. A rerun of the election was held on November 30, 2019, and during it it was uncovered that Dino Melaye had intended to boycott the poll, despite the fact that he was spotted voting on the day in question. He ran for governor of Kogi State on November 16, 2019. Dino Melaye came in third place, 748 votes behind the winner, Engr. Musa Wada, in a heatedly contested primary election on September 3, 2019.
